Though Sunday is considered as Holiday(exceptions
are always there and one of the exception is Nirma university, which made
Sunday just like another busy day.). All the students were required to remain
present even on Sunday otherwise suspension would be granted to the students
who were remain absent. Since there is 85% attendance criteria so it is the
only tool through which they try to maintain discipline by imposing strict
rules and regulation by blackmailing the students about suspension. And
suspension is not only blackmailed, but also granted. The recent example is not
very far, The students who were absent on 27th and 28th
jan (National conference organised by college) were suspended for 2 days in
addition they were marked absent in 12 attendance. Finally the hectic schedule
and complex time period culminated with the end of the 27th Bar
council of India moot court competition 2012.
Nirma is the first private law university to hold bar
council Moot court competition and we, as the students of Institute of law,
Nirma university got privilege of attending the auspicious moot pleadings
performed by 48 teams from all over the country. The opening ceremony was held
on 17th feb 2012 at 4-6 PM in Nim auditoriam. The competition was
started by former chief justice of India Mr. A.M.Ahmadi. Though it was
difficult to head to college on holidays, but there was an urge from inside
that keeps on igniting the zeal to look out the pleadings. I was amongst the
few students who came on Saturday. (as it was not compulsory to attend that
day) Everything was managed so well by our university that every thing done for
the treatment of ‘’mehmaan’’ was worth appreciating. All the volunteers and
court martials(choosen after proper interview) were allotted their duties many
days ago. The works that were assigned to them are hospitality, transport,
management etc. The work of court martials was to assist the judge during the
moot court session. Bar council and Nirma Batches were assigned to each and
every volunteers and participants. The volunteers were allotted car and
vehicles to receive the delegates. Many problems aroused (like a team from one of
the college missed their moot memorial in the train), but everything was
handled by the student coordinator devanshi popat very piteously.
There were 4 rounds and legal luminaries of the supreme
court were invited as judges. Many teams were disqualified in the 1st
and 2nd round that was based on criminal law and corporate law respectively. Though I attended both but
could not restrain myself from taking nap in between the 2 hours corporate
moot, so could not understand the insights of corporate law problem. The teams
whose pleadings I have seen were from GNLU, Gandhinagar and amity Noida. That day every classrooms were
converted into moot courts and every team was pleading in the respective
classes. The audience was free to chose their choice of room to see the
pleadings. It was nice learning experience from the students of various law
colleges across the country. It was a great opportunity as I get to learn many
informations and could identify and analyse the court manners and language.
The semi finals and finals were held on Sunday (which was
compulsory for everyone to attend) based on the problems relating to
Environment and constitutional law respectively. The teams that reached the
semi- finals were from NLIU Bhopal, symbiosis Noida, excellence college Chennai
and Nalsar, Hyderabad. I could not attend the semi finals because of some
reasons. But I was there in the finals that was a constitutional law problem.
The teams in final were excellence Chennai and Nalsar Hyderabad. By the time I
reached the seminar hall, it was almost full with the audience and there was no
place for any single addition. So we were escorted to the seminar hall, where
they had planned to show the final pleadings on the projector. Means live was
going on in the moot court hall and we were seeing it on the projector in
seminar hall. The pleadings were too good. I thought that the team from
excellence college would surely win because they pleaded so well. Their
arguments and body language and fluency of language, everything was too good
and worth appreciating. The Honorable judges of the dice were Gyan sudha Mishra(supreme
court judge), B.N. Srikrishna(retired judge of supreme court), J.M.panchal(
judge of supreme court), justice A.P.shah(retired judge of SC) and Zafar ahmed
khan( vice chairman, bar council of India). Pleadings of final round culminated
at 4 PM and most of the students were sleeping. We headed to the Nim auditoriam
for the valedictory function.
A short speech was delivered by B.N shrikrishna where he
highlighted that money is not important, knowledge is important. Lakshmi
supports the foolish people and saraswati supports the learned people. Lakshmi
was asked why she always supports foolish people but not learned or knowledgeable
people? For which she replies that it is true that I support the foolish people
because the learned people have support of saraswati and they are mindful
people and foolish people if not supported by me have nothing to show off. When
he said this the hall was cheered in to clappings. It is to be noted that B.N
srikrishna is also a chairman of 6th pay commission. So he has
balance his life very well between a foolish (money minded) and learned
(knowledgeable) personality.
Gyan sudha misra focused on the present scenario of legal
education and also on the role of girls in legal education. She also cited an embarrassing
remarks made by a student on her, when she was a 1st year law
student ‘’ye yahan kya kar rahi hai? Kya apne husband se divorce legi law
padke?” She cited this because she wanted to teach that a balance should be
maintained in law and if one is studying law does not mean that they should
fight for each and every irrelevant issue. A girl learning law should try to
avoid the conflicts arising in the family and should develop a balance so as to
avoid such divorce cases. The speech was very inspiring. Her selection of words
were worth appreciating. It was a great honour and privilege for me, that I
could encounter the speech delivered by her.
Finally the results were announced by Tyagi sir, the
competition is won by Nalsar university Hyderabad and obviously the runner up
team is excellence college, Chennai. I don’t remember the names of the students
who got the best speakers(male and female) and best advocates(male and female)
award. Finally the teams of every participating college were granted certificate
of participation and the programmer culminated.
I got to learn many things in this competition, even when I was
just an audience. That was a learning competition. Nirma University is also organizing the International moot court competition this year itself and I’m
looking forward to attend it.
